Thailand became the 142nd country to ratify the Patent Cooperation Treaty. This makes life very simple when obtaining a patent as one filed in Thailand is now applicable worldwide. This was not the case before.
Thailand’s membership to the Paris Convention for the Protection of Industrial Property took place on December 24th, 2009. The question now on most inventors minds is the following – what does it entail and how does it simplify the process globally:
- You now only file with the Department of Intellectual Property in Thailand and it is valid in all PCT countries;
- Costs are reduced as before you had to file a patent in Thailand and the US and EU. That has been made away with;
- Database searches are also now international and not local only;
- The process is now faster and streamlined;
Certain changes still need to be made this year with regards to the role and fees of the Ministerial Regulation No. 21 B.E. 2542. These will take effect this year and will place Thailand into the international arena.
